1. The Property Villa Alycia, Dalyan, Mugla, Turkey is offered for holiday rental subject to agreement and confirmation by Mrs Pauline Diplock. (The Owner).

2. Occupancy and Rental Cost

The price for the villa during the rental period is as stated on our website www.ourvillainturkey.co.uk and is for a maximum total of 8 people, plus a cot, highchair and stairgates which are provided for a toddler. There are no sofa beds and no sleeping is allowed except in the beds provided. The property is not wheelchair accessible (please consider our Access Statement if you have any mobility problems.)

3. Making and paying for a Reservation

To reserve the property, you should sign the Terms and Conditions and Booking Form and return them with the deposit (25% of the total cost of the rental.) We will confirm receipt of all monies and rental agreement by email. The Deposit, Balance and Security Deposit may be paid either by card over the phone, by BACS, or in cash.

4. Paying the Balance

The balance of the rental, together with the £250 Security Deposit is payable not less than 6 weeks before the start date of your holiday start date. If payment is not received by the due date, we reserve the right to give notice of cancellation of the reservation by email or post. You will remain liable to pay the balance of the rent unless we are able to re-let the property.

5. Late Bookings

If the booking is made within 8 weeks of the holiday start date, you will need to pay the whole amount of the rental, plus the security deposit.

6. Security Deposit

A Security Deposit of £250 is required in case of, e.g. damage to the property or contents, or excessive consumption of electricity due to unreasonably excessive use of the air conditioning. However, the sum reserved by this clause shall not limit your liability to us, the owners. We will return the security deposit to you, unless there is a deduction to be made, after inspection of the property after you leave.

7. Cancellation Policy

If you have to cancel the booking at any stage, we will return any money received, in accordance with the terms of our Cancellation Policy, providing we can find another renter for the period. In the event of cancellation, no charge will be made so long as written notification is received at least 6 weeks in advance of the date of stay,

at least 6 weeks prior to your stay, otherwise a charge will be made as follows:

• Cancellation received more than 8 weeks before the holiday start date: No charge.
• Cancellation received between 4 and 8 weeks before holiday start date: 50% of total rental.
• Cancellation received in 4 weeks or less before holiday start date: 100% of total rental
• If notice of cancellation is not received and you do not arrive 100% will be charged.

8. Travel Insurance

Prior to booking, in order to safeguard your situation, we strongly recommend that you take out adequate travel insurance for all members of your party to cover all risks and liabilities, including cancellation.

9. Rental Period

The Rental Period shall begin at 4pm on the first day, and finish at 10am on the last day. Please respect these times to enable the property to be cleaned and prepared for yourselves and for subsequent occupants.

10. Personal Property

All personal property, including any rental car, is left in the villa at your own risk; we take no responsibility for any loss, theft or damage to such property.

11. Considerate Tenants – your Agreement as the Responsible Person.

As the Responsible Person, you agree to be a considerate Tenant, to take good care of the property and leave at the end of the rental period. When you leave the property, cleaning is included in the rental price, but we reserve the right to make a retention from the security deposit to cover additional cleaning costs if you leave the property in an unacceptable condition. Please note, if you wish additional cleaning to be done during your holiday, this is not included in the rent and is payable by you to the manager

12. Neighbourliness

As the Responsible Person, you agree to be a considerate Neighbour. You agree to ensure members of your party have due regard to local residents and other holiday makers. Complaints from neighbours about excessive noise, very loud music and any disturbance after midnight etc, may result in retention of the Security Deposit, or termination of the contract without compensation to you, The Tenant.

13. Subletting

You may not, under any circumstances, re-let or sub-let the property, even free of charge. This is enforceable by Turkish Law’

14. Use by Other Persons

No tents, caravans or camping cars can be accepted on the property. No people other than those on the booking form may stay at the property or use its facilities (pool, showers, accommodation etc).

15. Smoking

For your comfort, safety and convenience we operate a strict no smoking property both inside and outside the villa. Anyone found to have violated this rule will have their card debited to cover the cost of deep-cleaning the whole villa.

16. Caveats –

Circumstances affecting to the Property

We are not to be held liable for any temporary stoppage in the supply of any public services to the property, nor for any outcome of any adverse weather conditions, or Act of God which might affect you whilst occupying the property, nor resulting from any matter outside of our control.

17. Extent of our Responsibility

No responsibility will be accepted by us for any accident or injury to any person in or around the environs of the property, which might be considered due to neglectful or thoughtless behaviour on the part of the person to whom either the accident or injury occurred, or which was the result of neglectful or thoughtless behaviour by a person causing the accident or injury to occur to another person.

18. Care by the Pool and Indoors

Special care should be taken around the pool and on outdoor steps, where the surface may become slippery when wet. Special care should also be taken also indoors if water should occur on the tiled floor and/or stairs, due to people entering the house with wet feet or clothing

19. Liability

Under no circumstances shall our liability to you exceed the amount you pay to us for the rental period.

20. This Agreement shall be Governed by English law.
